Conditions

Please read carefully before purchasing or accessing any product or program.

Please read these Terms and Conditions of Use ("TOU") carefully before purchasing, accessing, or using any product, program, or service offered by The Leadership House, a division of EJ Encalarde, LLC.

By enrolling in, purchasing, or accessing any digital resource, online course, workshop, group coaching program, one-on-one coaching session, live training, or private online community operated by EJ Encalarde, LLC — whether hosted on our platform or a third-party platform such as Kajabi — you are agreeing to be bound by these TOU. Collectively, these offerings are referred to as "the Product." If you do not agree with these TOU, you may not use the Product.

Definition of "Releasees." As used in these TOU, "Releasees" includes: (i) EJ Encalarde, LLC, its subsidiaries, affiliates, owners, members, managers, directors, officers, past and present employees, agents, coaches, representatives, successors, and assigns (collectively "the Company"); (ii) any Company volunteers; and (iii) EJ Encalarde individually.

The Product

The Leadership House offers a suite of leadership development products and services, including online courses (including Festival Leadership Foundations), workshops, group coaching programs, and one-on-one strategy and coaching sessions — all designed to support festival and event industry professionals in building sustainable, identity-grounded leadership.

The specific tools, resources, content, and access you receive will be as outlined on the sales or enrollment page for your selected Product. The Company reserves the right to modify, update, or improve any Product at any time, provided the core scope of the offering is maintained.

Payment

You agree to the fees and payment schedule for the Product selected at the time of checkout.

Pay-in-Full

If you selected the pay-in-full option at checkout, you agree to make one immediate payment in the amount indicated on the sales page.

Installment Plan

If you selected an installment payment option at checkout, you agree to make each installment payment as indicated on the sales page, on time and in full. Installment payments will be due on the same calendar day each month until your payment obligation is complete. Enrollment in an installment plan does not reduce your total obligation — all installments are required regardless of your continued use of the Product.

By providing your payment information, you authorize the Company to charge your credit or debit card for all fees and charges due, without additional authorization, for which you will receive an electronic receipt. You also agree that the Company is authorized to share payment information with its third-party payment service providers as necessary to complete the transaction.

If payment is not received by the date due, the Company reserves the right to suspend or terminate your access to the Product and all Content immediately. If you fail to make timely payments, voluntarily withdraw, or discontinue use of the Product for any reason, you remain fully responsible for the total cost of the Product. The Company reserves the right to charge a late fee on all balances more than 30 days overdue, up to the highest rate allowable by law. You agree to reimburse the Company for all collection and/or legal fees necessitated by lateness or default in payment.

Refund Policy

Your investment and satisfaction with the Product are important to us. Unless a specific refund period is outlined below, all sales are final and no refunds will be provided. All refunds are discretionary as determined by the Company, unless otherwise required by law.

Upon approval of a refund, the Company will promptly issue an instruction to its payment processor. The Company does not control its payment processor and cannot expedite refunds. Approval of a refund immediately terminates all licenses granted to you under these TOU. You must cease using all Product materials and remove them from your business within 14 calendar days of the refund being initiated.

Festival Leadership Foundations — 7-Day Test Drive

The Company offers a 7-day "test drive" refund period for purchases of Festival Leadership Foundations. To request a refund, you must submit a written refund request to ej@ejencalarde.com no later than 11:59 PM CST on the 7th day following your purchase. Your request must include: (1) the reason(s) the program was not the right fit for you, and (2) your acknowledgment that you will immediately cease use of all course materials. Refund requests that do not include both items will not be considered. After day 7, all payments are non-refundable and you remain responsible for any outstanding installment payments.

If you feel the Product is defective or unsatisfactory compared to what was represented, please reach out to ej@ejencalarde.com and we will work with you to find an appropriate resolution.

The Company will not tolerate or accept any chargeback threats or actual chargebacks from your credit card company or payment processor. If a chargeback is placed on a purchase, the Company reserves the right to report the incident to credit reporting agencies or chargeback databases. Chargeback abusers wishing to be removed from any such database must make payment for the full amount of the chargeback.

Coaching & Strategy Calls

Due to the nature of one-on-one coaching and strategy calls, refunds will not be issued unless otherwise specified in writing at the time of booking. You may reschedule your call one time without financial penalty, provided you do so at least 48 hours in advance of the scheduled appointment.

The Company reserves the right to reschedule calls in the event of illness, emergency, or other circumstances beyond its control. In such cases, the Company will make every reasonable effort to offer a timely alternative appointment.

Intellectual Property & Ownership

All content accessible through the Product — including but not limited to videos, audio recordings, written training materials, frameworks, slide presentations, documents, graphics, images, templates, data, and course content (collectively, "Content") — is the intellectual property of EJ Encalarde, LLC and/or its licensors. This includes all proprietary frameworks developed by EJ Encalarde, such as the Three Depths Framework, Deep Identity, Deep Stillness, Deep Agility, and any other methodologies, models, or branded concepts presented through The Leadership House. All Content is protected by applicable copyright, trademark, and intellectual property laws.

All trademarks and logos displayed in connection with the Product are the property of EJ Encalarde, LLC unless otherwise indicated. Any unauthorized use of these marks is strictly prohibited.

All rights not expressly granted in these TOU are reserved by the Company.

Your License & Permitted Use

By purchasing or accessing the Product, you are granted a revocable, non-transferable, non-exclusive license for personal, non-commercial use only. This license is limited to you individually.

This means you may access, view, and apply the Content for your own professional and business development. You may not republish, reproduce, duplicate, copy, sell, distribute, share, or otherwise make available any portion of the Product or Content to any third party — for compensation or otherwise — without prior written permission from the Company.

You agree to pay liquidated damages of five (5) times the total fees paid for the Product in the event of unauthorized use, or a minimum of $5,000 if you accessed the Product at no cost, in addition to any other legal or equitable remedies available to the Company.

To request permission to use any Content beyond the scope of your personal license, contact ej@ejencalarde.com in writing before any use occurs.

Your License to the Company

By submitting any material — including comments, posts, photos, images, or other contributions — through any Product platform or community operated by the Company, you represent that you are the owner of such materials and at least 18 years of age. You grant the Company an unlimited, royalty-free, perpetual, worldwide license to use, copy, modify, distribute, and display your contributions in connection with the Product and Company marketing, without further permission or compensation.

You also consent to any photographs, video recordings, or audio recordings made by the Company during your participation in the Product — including webinars, live sessions, or community calls — that may include your voice, image, or likeness. The Company reserves the right to use such recordings for marketing, educational, and archival purposes at its sole discretion.

Conduct & Confidentiality

You agree to engage respectfully and professionally in all Company-operated spaces, whether hosted on our platform or a third-party platform such as Kajabi or any online community forum. Any communication must be constructive, accurate, and free from abusive, harassing, threatening, defamatory, or obscene content.

If applicable, community and forum participation is subject to additional Community Guidelines that are incorporated into these TOU by reference. The Company reserves the right to update those guidelines at any time.

You are strictly prohibited from the following:

  • Reproducing, sharing, or distributing any Company Content or proprietary frameworks outside of your personal use license
  • Using any Company platform for unlawful, fraudulent, or harmful purposes
  • Transmitting unsolicited communications, spam, or malicious software through any Company platform
  • Sharing other participants' personal information or business details outside the program
  • Soliciting or promoting third-party products, services, or events within any Company platform or community without prior written approval
  • Using discriminatory language or engaging in conduct that demeans others based on sex, gender, age, race, ethnicity, religion, disability, or similar characteristics
  • Harassing, intimidating, or disrespecting other participants or Company staff

Violation of these conduct standards may result in immediate and permanent termination of your access to the Product and all Content without refund, at the sole discretion of the Company.

The Company strives to maintain a safe, inclusive environment for all participants. However, the Company cannot guarantee the conduct of third parties and shall not be held liable for another participant's actions, posts, or content.

Account Credentials

To access the Product, you may need a username and password on our course platform (Kajabi) or another designated platform. You are solely responsible for maintaining the confidentiality of your login credentials and agree not to share access with any other person.

During registration, you agree to provide true, accurate, and current information about yourself. If the Company has reasonable grounds to believe you have provided false information or shared your credentials, the Company reserves the right to suspend or permanently terminate your account and access to the Product without refund.

Any personally identifiable information you provide is governed by the Company's Privacy Policy.

Termination or Cancellation

The Company reserves the right, in its sole discretion, to suspend or terminate your access to the Product and Content, in full or in part, at any time. Upon termination, you are no longer authorized to access or use the affected portion of the Product. The restrictions imposed on you in these TOU continue to apply after termination.

In the event you choose to cancel or discontinue participation, any remaining installment or balance-due payments become due immediately. Cancellation does not entitle you to a refund except as outlined in the Refund Policy section above.

Personal Responsibility, Disclaimers & Assumption of Risk

By engaging with the Company through your purchase of the Product, you knowingly and freely assume all risk and responsibility for any outcomes — personal, professional, or otherwise — and release and hold Releasees harmless from any and all claims, liabilities, damages, costs, or expenses of any kind arising out of or connected with your purchase and use of the Product.

The Product and Content provide education, frameworks, and professional development resources only. They do not constitute and are not a substitute for legal, financial, medical, psychological, or therapeutic advice. None of the Content prevents, cures, or treats any mental or physical condition. You are responsible for your own decisions, choices, actions, and results. You are encouraged to consult qualified professionals for advice specific to your individual situation.

Earnings & Results Disclaimer. The Company makes no representations about the financial results, career outcomes, or professional advancement you may achieve through use of the Product. Individual results will vary based on experience, effort, market conditions, and other factors outside the Company's control.

Any links to third-party products, services, or platforms — including Kajabi — are subject to that third party's separate terms and conditions. The Company is not responsible for content on or actions taken by any third-party website or platform.

THE PRODUCT AND CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE PRODUCT OR CONTENT.

Security

The security of your personally identifiable information is important to us. While we take reasonable measures to protect your data, no transmission over the internet can be guaranteed 100% secure. By submitting information to the Company, you acknowledge and accept this inherent risk. The Company will not be held liable for any breach of data that is beyond its reasonable control.

Legal Disputes

These TOU shall be governed by and construed in accordance with the laws of the State of Louisiana, without giving effect to its conflict of laws principles. The state and federal courts located in New Orleans, Louisiana shall have exclusive jurisdiction over any dispute arising from or relating to the Product, Content, or these TOU. By using the Product, you hereby submit to the personal jurisdiction of those courts and waive any defense of forum non conveniens.

The prevailing party in any dispute between the parties arising from or related to these TOU — whether resolved by negotiation, mediation, or litigation — shall be entitled to recover its reasonable attorneys' fees and costs from the other party.

Indemnification

You agree to defend, indemnify, and hold harmless the Company and its directors, officers, agents, contractors, partners, successors, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or in connection with: (i) your use of the Product or Content in violation of these TOU; (ii) any breach by you of any representation, warranty, or obligation under these TOU; (iii) any material you submit through any Company platform; (iv) your violation of any applicable law or third-party agreement; or (v) any claim that your content infringes upon the rights of a third party.

Force Majeure

The Company shall not be deemed in breach of these TOU if it is unable to deliver any portion of the Product due to circumstances beyond its reasonable control — including but not limited to fire, natural disaster, labor disputes, acts of God, epidemic, pandemic, death or incapacity of EJ Encalarde, or any local, state, or federal government order or regulation (collectively, "Force Majeure Event").

Upon the occurrence of a Force Majeure Event, the Company will promptly notify you of the inability to perform and may propose alternative accommodations or, if necessary, terminate the applicable TOU with appropriate consideration of any fees paid.

General Provisions

The Company may modify these TOU at any time. All modifications will be posted on the Company's website, and you will be notified of material changes upon accessing the Product or by email. Continued use of the Product after notification constitutes your acceptance of the updated TOU.

If any provision of these TOU is found to be invalid or unenforceable, the remainder of the TOU will remain in full force and effect, and the invalid provision will be replaced by a valid, enforceable provision that most closely reflects the intent of the original.

These TOU represent the entire agreement between you and the Company with respect to the Product and supersede all prior written or oral representations, agreements, or understandings. If you have any questions, please contact us at ej@ejencalarde.com.

Your Agreement

By purchasing, enrolling in, or accessing any Product offered by The Leadership House, you confirm that you have read, understood, and agreed to these Terms and Conditions in their entirety.

Your electronic agreement at the time of checkout — including clicking a confirmation checkbox or completing a purchase — serves as the legal equivalent of your signature and constitutes your full acceptance of these TOU. If you do not agree, please do not purchase or access the Product.
